By accessing and/or using Kura and any materials/information therein (Material), I acknowledge and agree to comply with the following:

 

This platform is operated by Canon Europa N.V. Bovenkerkerweg 59, 1185 XB Amstelveen, Netherlands. These terms and conditions together with Canon's Privacy Policy apply to my access and use of Kura. By accessing and/or using Kura I accept these Terms and Conditions of Use and Canon's Privacy Policy.

 

I understand and agree that these terms and conditions are additional to any contractual obligations (including marketing and confidentiality agreements) that my company has entered into with Canon and I accept that those contractual obligations and these terms and conditions are legally binding on me.

 

I agree and accept that the Material available on Kura is strictly confidential and I shall not use such Material except as agreed with Canon Europa N.V. and for the benefit of Canon and the Canon group. I further agree and undertake that I shall not disclose the Material to any unapproved third parties. I may only disclose confidential information to persons involved in Canon's marketing communication process on a strict need-to-know basis for the benefit of Canon and only when such persons have confidentiality obligations similar to the ones my company has with Canon.

 

I understand and agree that in order to access Kura, I must be registered. Registration is activated by Canon. I shall not disclose my username and password to anyone. External users wishing to obtain access to Kura should contact a local Canon super user.  Employees should apply for access via the iAMCanon system. 

 

I acknowledge that it is strictly forbidden to store pre-embargo Material on any other remote system (hard drive, etc.) or on any public or publicly available servers or websites.

 

I shall ensure the accuracy of any Material that I upload to Kura (including without limitation to embargo dates and permissions). I also agree and undertake that any Material uploaded to Kura shall not be defamatory obscene, offensive, hateful or inflammatory, it shall not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age or be illegal and shall not infringe any third party rights. I further agree and undertake that before I upload any Material containing images of people, buildings or other products I shall ensure that I have cleared all necessary rights (including obtaining all necessary moral waivers and permissions).

I shall ensure that I comply with and observe all restrictions and limitations applicable to the Material (including without limitation time, purpose, territory). In the event, the permissions or time limitations expire I shall immediately stop using such Material.

 

I shall use all the information only as indicated and shall respect all intellectual property applicable to the Material and give due credit as necessary to the authors or owners of the Material as directed.

 

I accept and agree that non- compliance with any of the above terms constitutes a material breach and without prejudice to Canon's legal rights and remedies may result in Canon, at its sole discretion, terminating, suspending or revoking my access to Kura, on a temporary or permanent basis. Canon excludes all and any liability for all action Canon may take in response to breaches of these terms.

 

If I repeatedly infringe other people's intellectual property rights, I understand that Canon may disable my account when appropriate.

These terms are governed and interpreted in accordance with Dutch Law.

 

All disputes which may arise from this Agreement will be resolved exclusively by the District Court of Amsterdam the Netherlands.Canon shall have, however, the sole right to waive this section and to enforce these terms under the local law and/or jurisdiction of the user.
